I have a mediation coming up in my serious injury motor vehicle accident personal injury claim. What should I expect? Well, mediations are very common and mediations are a good forum for the parties to a litigation…specifically for a motor vehicle accident. The injured victim and the at-fault driver come together with their attorneys to try to settle the case. During a mediation there will be a "third party mediator", that could be a judge in the state of Maryland or could be a separate attorney who was there to play as a separate independent individual to try to help both sides negotiate with the hopes of settling the personal injury case. What you can expect is that as the injured victim you're going to want to accept less than what maybe you would obtain at trial but also the at-fault driver will want to probably offer more money than they may want to settle your personal injury for. Again, it's basically a negotiation. It's a back-and-forth exchange and everything that is said at a mediation is totally confidential and can not be used in court If your personal injury case ever goes to trial.
