Why is CCTV video footage of a pedestrian accident so critical if an injured victim wants to prove and bring their pedestrian accident personal injury claim in a Maryland state court? Almost all of the time, at-fault driver insurance companies fight tooth and nail to defend a person who is bringing a pedestrian accident personal injury claim against their insured. In Maryland, we have a harsh rule called Contributory Negligence. What that means is that if the pedestrian who was injured is found even one percent at fault for the pedestrian accident, they are barred from recovery and cannot recover any of their incurred medical bills, lost wages, and as well, any compensation for their pain and suffering from the pedestrian accident.
Obviously, a video speaks a thousand words. A video is the best evidence. A video is the best eyewitness of how the pedestrian accident happened. A lot of times, depending on where it is, there is CCTV footage available from the cameras on the street at the traffic lights that could have captured the pedestrian accident. It is so critical that the injured victim and their lawyer as soon as possible immediately send subpoenas and requests to the local police department in order to obtain the CCTV camera footage. The police departments are well-versed and understand why personal injury lawyers and injured victims will be doing this, and they're usually very cooperative in sending the injured victim and their lawyer any CCTV video footage immediately if it's available.
