How can an injured victim who suffered serious injuries in a car accident bring a personal injury claim when the injured victim was a passenger in one of the cars involved, but the injured victim is not entirely sure which driver or drivers are at fault for the car accident itself? The answer is simple.
Under a case like this, and it happens all the time, the injured victim who suffered severe injuries as a passenger in one of the cars, who clearly is not in any way, shape, or form at fault, needs to file a lawsuit in a Maryland state court against all of the drivers involved.
What this does is put all of the driver's insurance companies on notice of a lawsuit, and it allows them to fight the passengers' fight for them. They will litigate amongst each other through depositions and other types of evidence, and try to figure out which driver or drivers are at fault for the accident, and which driver or driver should be appropriately compensating the injured victim who was a passenger and clearly not in any way, shape, or form at fault for the accident.
It is not uncommon whatsoever that before a lawsuit is filed, all the driver's insurance companies involved will deny the injured victim's claim. They'll say, Well, this other driver, this other driver, and all the drivers contributed to the accident. So for these reasons, we deny our claim. That is exactly why a lawsuit needs to be filed against all the drivers involved and let them fight it out.
