What are the four elements you need to prove to successfully win your motor vehicle accident and personal injury claim? Number one, you need to show that the at-fault driver had a standard of care to the injured victim on the roadway. This is rather obvious. Everybody knows that all motorists on the road owe a amount of reasonable care to every other motorist on the road to drive correctly and not break any rules. Number two, you need to show that the at fault driver actually breached that standard of reasonable care owed to the injured victim. This could mean many things. It could be failing to yield the right of way, running a stop sign, running a red traffic light. You name it. The various ways that an at fault motorist could have breached the accepted standard of care and the reasonable care owed to the injured victim, you just need to prove it. Number three, you need to show that the at fault drivers breach of the reasonable care owed to the injured victim caused the injured victim's injuries. This is usually pretty easy. If the at fault driver runs a stop sign, crashes into the injured victim's motor vehicle and the injured victim suffered injuries, there you go. The at fault driver having breached the standard, running the stop sign, caused the injured victim's injuries. Finally you need to actually prove that the injured victim suffered cognizable damages It's a legal term of art to successfully bring their personal injury claim. In other words, let's say that at fault driver runs a stop sign, crashes into the injured victim's car, but the injured victim didn't suffer any injuries. They didn't go to the hospital. They didn't seek physical therapy treatment. They didn't go to their primary care doctor. And they just didn't suffer any injuries at all. If the injured victim suffers no injuries, you can't actually bring a personal injury claim.
