How can you ensure that video footage of a motor vehicle accident can be admitted into evidence at trial for someone's serious injury car accident case? Video evidence, specifically video footage of the actual car accident itself Is obviously the most powerful evidence of how the accident occurred.
There's no need for eye witnesses when you have a video showing them how the accident happened, whether it's dash camera footage or CCTV footage or footage from a business, there are different ways to ensure that that actual video footage can be admitted into evidence and be shown to the jury at trial.
There are two main ways. Number one is rather easy. Somebody with personal knowledge of how the accident occurred can view the footage and say that the footage is a fair and accurate representation of how they remember from their own experience the car accident occurring.
You have one of the drivers involved authenticate the video, you can have an eyewitness look at the video, you name it. Just simply, it needs to be somebody with personal knowledge. Somebody who was actually involved or actually saw the car accident occur.
The other way is a little more nuanced and it's called the Silent Witness Theory. If for some reason the injured victim and their lawyer can't find somebody who remembers the accident and actually saw it, they can call a, it's called a custodian of records to testify about the operations and the necessary operations of the video program that actually captured the footage.
