If you are seriously injured in a motor vehicle accident involving somebody who is driving a rental car, how would the person possibly get compensated?
Well, the answer is simple, and the injured victim can be rest assured that even if the at-fault driver has no personal automobile insurance, the rental car company in this example, let's say Enterprise, they are legally required to have insurance up to the Maryland State minimum of $30,000 to compensate the injured victim for their injuries.
Now, however, if somebody is seriously injured and the person has a personal automobile policy that is above the rental car coverage, say $50,000, $100,000, or more, the injured victim can certainly go after the at-fault driver's rental car coverage and or their personal automobile insurance coverage.
It is critical that if an injured victim suffers serious injuries in a motor vehicle accident involving somebody driving a rental car, they need to immediately obtain and consult an experienced Towson personal injury lawyer. More likely than not, and I would say almost every time, rental car company insurance companies they play hardball.
They won't do anything unless a lawsuit is filed against their insured, the rentee, and the injured victim goes through the litigation process.
