What is a pretrial conference for your car accident personal injury case, and why is it significant? The pretrial conference is one of the biggest events in the litigation of a person's serious injury car accident claim. A pretrial conference is always at the courthouse and is with a trial judge who will listen to both sides and try to potentially resolve the case as a last-ditch effort prior to a jury trial.
The people present at the pretrial conference will usually be, number one, your own attorney and yourself, and the Defense Attorney, the Insurance Defense Attorney, and one of the Insurance Adjusters for the Insurance Company of the at-fault driver.
The Judge will listen to both sides of everybody's claims and defenses, and the judge will try to…make a last-ditch effort to get the parties to resolve the case. At this time, the case is usually very close to trial, so it is critical that the injured victim and their lawyer take into consideration the judge's recommendations and the other side's arguments in determining whether a pretrial settlement is the best avenue.
