What is an umbrella policy, and how does an umbrella insurance policy dictate the potential value of an injured victim's serious injury car accident case?
An umbrella policy is substantial and can raise the value significantly for an injured victim's car accident case. For example, let's say an injured victim gets into a motor vehicle accident that's not their fault and has a $100,000 to $200,000 worth of incurred medical bills for their treatment for their injuries.
Now, the at-fault driver, let's say they have a personal auto policy of say, $100,000. If this is the only insurance policy available, unfortunately, for the injured victim, almost under every single circumstance, they will only be able to collect $100,000, the insurance policy limit, from the at-fault driver.
However, if the at-fault driver lives in a home, maybe under their parents' policy, and they have an umbrella policy of $1,000,000, the injured victim can now collect $1.1 million of coverage; the $100,000 personal insurance policy plus the $1,000,000 umbrella policy.
Obviously, an umbrella policy, given that example, substantially increases the value of the injured victim's car accident claim. It is vitally important that the injured victim and their attorney search for every single avenue of insurance coverage available.
Usually, insurance companies will not willingly give up umbrella policies. There needs to be a lawsuit filed. The injured victim needs to go through the litigation process to get their hands on a potential umbrella policy.
