Failing to Yield in Maryland: Know the Impact on Your Accident Claim (VIDEO)

In this video, auto accident attorney John Leppler explains the concept of failure to yield and how it can strengthen your Maryland car accident claim, especially when the police report identifies the other driver as being at fault for failing to yield.

Video Transcript:

What does it mean in Maryland when the at-fault driver failed to yield the right of way and caused a motor vehicle accident? What that means is that one of the drivers either simply failed to yield under Maryland law and under the basic rules of the road.

For example, somebody ran a stop sign. Somebody rear-ended somebody else. Under these scenarios, the persons who have a red stop sign must yield to all other cars that are in the intersection and going through the intersection.

In a rear-end collision scenario, the car in the back behind the motor vehicle must keep a safe and reasonable distance from their own motor vehicle to the car in front of them, so the front of their car doesn't hit the back of the car in front of them, ie a rear-end motor vehicle collision.

Almost all the time, the investigating police officer will put in the police report, number one the driver who's at fault; and number two, the driver who failed to yield the right of way or failed to give full time and attention.

Obviously if an injured victim trying to bring a personal injury claim, it's a lot easier for them if they have the police report and it's documented that the other driver failed to yield the right of way and caused the accident.
